ORDINANCE NO.  67

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ROLAND, IOWA, 2003, PERTAINING TO THE BURNING OF LEAVES WITHIN THE CITY LIMITS OF ROLAND.

 Be It Enacted by the City Council of the City of Roland, Iowa:

 SECTION 1.  SECTION MODIFIED.  Chapter 105, Section 05, Subsection 5, of the Code of Ordinances of the City of Roland, Iowa, 2003, is repealed and the following adopted in lieu thereof:

 105.05 (5).  Leaf Burning.  The burning of leaves will be allowed only during the months of April, October & November from the hours of 8:00 am to dusk, as defined by the DNR (Department of Natural Resources) solar tables.

 SECTION 2.  SEVERABILITY CLAUSE.  If any section, provisions or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 SECTION 3.  WHEN EFFECTIVE.  This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

 Passed by the council the 27^th day of April, 2009 and approved this 27^th day of April, 2009.
