ORDINANCE NO.  66

 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ROLAND, IOWA, 2003, BY AMENDING SECTION 23.07, PERTAINING TO PARK BOARD JURISDICTION AND AUTHORITY.

BE IT ENACTED by the City Council of the City of Roland, Iowa:

SECTION 1.  SECTION AMENDED.  The Code of Ordinances of the City of Roland, Iowa, 2003, is amended by amending Section 23.07, entitled JURISDICTION AND AUTHORITY, which is hereby adopted to read as follows:

23.07  JURISDICTION AND AUTHORITY.  The Board has control of all parks and pleasure areas except the “Swimming Pool Recreational Area”.  Subject to the approval of the Council, the Board may sell, lease, exchange or acquire any real estate deemed by the Board to be beneficial to the City.

SECTION 2.  REPEALER.  All ordinance or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 3.  SEVERABILITY CLAUSE.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. 

SECTION 4.  WHEN EFFECTIVE.  This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
