ORDINANCE NO. 64

 

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ROLAND, IOWA, 2003, BY AMENDING PROVISIONS PERTAINING TO SPECIAL SPEED RESTRICTIONS.

 

BE IT ENACTED by the City Council of the City of Roland, Iowa:

 

SECTION 1:  SECTION MODIFIED.  Section 63.04, is hereby repealed and the following adopted in lieu thereof.

 

            63.04.  SPECIAL SPEED RESTRICTIONS.  In accordance with requirements of the Iowa State Department of Transportation, or whenever the Council shall determine upon the basis of an engineering and traffic investigation that any speed limit listed in Section 63.02 is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of the City street system, the Council shall determine and adopt by ordinance such higher or lower speed limit as it deems reasonable and safe at such location.  The following special speed zones have been established:

                        1.  Special 25 MPH Speed Zones.  A speed in excess of twenty-five (25) miles per hour is unlawful on any of the following designated streets or parts thereof.

                                    A.  Walnut Street - from Cottonwood Street to Vine Street

                                    B.  Ash Street - from Cottonwood Street to Vine Street

                                    C.  Poplar Street - from Cottonwood Street to Vine Street

                                    D.  Maple Street – Beginning from the northern side of the West Corporate Line, East to the northern side of the East Corporate Line.

                                    E.  Cottonwood Street - Beginning 780 feet South of the North Corporate

                                    Line, South to the South Corporate Line.

 

                        2.  Special 35 MPH Speed Zones.  A speed in excess of thirty-five (35) miles per                            hour is unlawful on any of the following designated streets or parts thereof.

                                    A.  W. Maple Street - Beginning 530 feet West of the southern side of the                                            West Corporate Line, then East 634 feet to the northern side of the West                                      Corporate Line.

                                    B.  E. Maple Street – Beginning 200 feet West of the southern side of the

                                    East Corporate Line, then West 450 feet to the northern side of the East                                                 Corporate Line.

                                    C.  Cottonwood Street - Beginning 200 feet South of the North Corporate                                                 Line, then South 580 feet.

 

                        3.  Special 45 MPH Speed Zones.  A speed in excess of forty-five (45) miles per                            hour is unlawful on any of the following designated streets or parts thereof.

                                    A.  W. Maple Street – Beginning 220 feet East of the southern side of the

                                    West Corporate Line, then East 310 feet.

                                    B.  E. Maple Street - Beginning 200 feet West of the southern side of the                                            East Corporate Line, then West 200 feet to the southern side of the East                                      Corporate Line.

                                    C.  Cottonwood Street – Beginning 200 feet South of the North Corporate                                                 Line, then North 200 feet to the North Corporate Line.

 

                        4.  Special 55 MPH Speed Zones.  A speed in excess of fifty-five (55) miles per                            hour is unlawful on any of the following designated streets or parts thereof.

                                    A.  W. Maple Street – Beginning at the southern side of the West                                                           Corporate Line, then East 220 feet.

 

SECTION 2.  SEVERABILITY CLAUSE.  If any section, provisions or part of this ordinance be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 

SECTION 3.  WHEN EFFECTIVE.  This ordinance shall be in effect from May 1, 2009, after its final passage, approval and publication as provided by law.
